Keep the promise – Deliver the freehold!
In September 2025 WAMCLT was approached by the developers Vistry (under the Bovis brand name) to help them plan for a brand new community building and open space in this major new housing development of 320 homes west of Windsor. These facilities must be provided under the original Outline Planning Permission and section 106 legal agreement with The Royal Borough of Windsor & Maidenhead. The Community Building is scheduled to be ready late in 2027. WAMCLT provided a proposed Management Plan in November 2025 to the developers which was well received by RBWM.
The developers have told us that they have decided to request a variation in the s106 to allow them to build 8 “affordable” flats above the community centre and the freehold will go to Zen Housing Association. Their Reserved Matters Planning Application permits this.
This proposal will mean the community centre will have to have a lease with Zen. We don’t believe this is in the spirit of the original s106 which says the developer must provide the freehold of the building to the community free of charge. We oppose the proposal.
We have made an alternative solution, that the CLT take on the freehold and lease the flats to a Housing Association. We await a decision from RBWM.
